SpendGuard™ Acceptable Use Policy

This Acceptable Use Policy ("Policy") governs your use of the SpendGuard platform ("Service") provided by Constant Control Ltd. This Policy supplements our Terms of Service and applies to all users of the Service.
1. Permitted Use
The Service is designed for legitimate business purposes related to contract spend management, including tracking Consultancy Services Orders (CSOs), recording and monitoring budget utilisation, managing vendor relationships and project portfolios, and generating reports for internal governance and compliance.
2. Prohibited Conduct
You must not use the Service to engage in any activity that violates applicable New Zealand or international law; upload, store, or transmit any content that is unlawful, defamatory, or infringes any third party's rights; attempt to access accounts, data, or systems that you are not authorised to access; interfere with or disrupt the Service, its infrastructure, or other users' access; reverse engineer, decompile, or attempt to extract the source code of the Service; use automated tools (bots, scrapers) to access the Service without our written consent; transmit malware, viruses, or other harmful code; or impersonate another person or entity.
3. Data Integrity
You are responsible for the accuracy and integrity of data you submit to the Service. You must not knowingly submit false, misleading, or fraudulent financial data; manipulate budget, transaction, or reporting data to misrepresent financial positions; or use the Service to facilitate fraud, money laundering, or other financial crimes.
4. Account Security
You must maintain strong, unique passwords for your account; not share account credentials with unauthorised individuals; promptly report any security incidents or unauthorised access; and comply with your organisation's information security policies when using the Service.
5. Resource Usage
You must not use the Service in a way that places excessive load on our infrastructure. We reserve the right to throttle or restrict access if usage patterns suggest abuse or negatively impact other users.
6. Government Compliance
Government agency users must ensure their use of the Service complies with the Public Finance Act 1989 and any relevant appropriation requirements; the Official Information Act 1982 (noting that data stored in the Service may be subject to OIA requests); the Public Records Act 2005; and their agency's internal procurement and financial management policies.
7. Reporting Violations
If you become aware of any violation of this Policy, please report it to security@constantcontrol.co.nz. We will investigate reported violations and take appropriate action.
8. Enforcement
We may investigate suspected violations of this Policy and take action including issuing warnings, suspending access, terminating accounts, and reporting illegal activity to relevant authorities.
We will provide reasonable notice before taking enforcement action, except where immediate action is necessary to prevent harm or comply with legal requirements.
9. Changes to This Policy
We may update this Policy from time to time. We will notify you of material changes by email or through the Service.
